2. SERVICES OFFERED

Blueberry Tours offers a variety of services including, but not limited to:

Day Tours, Multi-Day Tours, Transfers, Holiday Packages, Excursions, Airport Pickups and Drop-offs

3. BOOKING CONFIRMATION: DAY TOURS, MULTI-DAY TOURS & TRANSFERS

• A non-refundable 20% deposit is required to confirm any Day Tour or Multi-Day Tour.
• The remaining 80% balance must be paid no later than 3 days before the scheduled activity.
• For Transfers, a non-refundable $15 deposit is required to confirm the booking, with the balance payable on the day of service.
• A copy of successful payment must be submitted as proof.

5. CANCELLATION & REFUND POLICY: DAY TOURS, MULTI-DAY TOURS & TRANSFERS

• More than 4 days before the activity: Refundable, excluding non-refundable amount.
• More than 24 hours before the activity (a full day before the activity): 50% refund of total amount due.
• Within 24 hours of the activity: No refund.

Exceptions:

• Medical reason: Must be supported with clinical evidence emailed to info@zanzibar.com. Refund issued minus non-refundable amount.
• Weather-related cancellations: If verified and approved by our operations Manager, we will reschedule or offer a full refund minus the non-refundable deposit.

7. CHILDREN POLICY – DAY TOURS, MULTI-DAY TOURS & TRANSFERS

• 1 – 8 Years: Free (except Jozani Forest, charged as 9 – 11 Years)
• 9 – 11 Years: 50% of adult rate
• 12 Years and above: Full adult rate

9. USER REPRESENTATIONS

By using our Services, you represent and warrant that:

1. You have the legal capacity and agree to comply with these Terms.
2. You are not a minor in your jurisdiction or have received parental consent.
3. You will not use automated or non-human means (e.g., bots) to access the Services.
4. You will not use the Services for any unlawful or unauthorized purpose.
5. Your use complies with all applicable laws and regulations.

10. DISCLAIMER

The Services are provided on an "as-is" and "as-available" basis. We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy or reliability of content or services and are not responsible for:

• Errors or inaccuracies in content
• Personal injury or property damage from service use
• Unauthorized access to personal/financial data
• Viruses or other harmful transmissions
• Service interruptions or technical issues
• Third-party advertisements or linked websites

Use all services at your own risk.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Blueberry Tours and its staff shall not be liable for any direct, indirect, incidental, punitive, or consequential damages including but not limited to lost profits, loss of data, personal injury, or property damage, arising from the use or inability to use our Services.

12. PRICE ADJUSTMENTS

• Prices are based on current exchange rates and local supplier costs.
• Blueberry Tours reserves the right to adjust pricing before confirmation.
• If the increase exceeds 10% of your total holiday cost, you are entitled to cancel with a full refund.

13. INSURANCE

It is strongly recommended that all clients obtain comprehensive travel insurance to cover medical costs, cancellations, delays, and personal belongings.

14. INDEMNIFICATION

You agree to indemnify and hold harmless Blueberry Tours, its affiliates, officers, employees, and agents from any claims, liabilities, losses, or demands arising from your use of the Services, breach of these Terms, or your violation of any rights of another.

15. USER DATA

We may store and use data related to your use of our Services for operational purposes. While we perform regular data backups, you are solely responsible for maintaining your own data. We assume no liability for data loss or corruption.

16. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

By using our Services, you agree to receive electronic communications, and consent to electronic agreements, transactions, signatures, and notices. This satisfies all legal requirements for written communication.

17. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will update the "Last updated" date accordingly. Your continued use of the Services after any modification constitutes your acceptance of the revised Terms.

18. GOVERNING LAW & DISPUTES

These Terms shall be governed by the laws of Tanzania. Any disputes shall be subject to the jurisdiction of the courts in Zanzibar, Tanzania.
